Broadspire Reimbursement Process-Guidelines on Hip Implant Recalls

At Childers, Schlueter & Smith we have handled hundreds of hip implant replacement claims for clients all over the country and we continue to do so on a daily basis. In this process, particularly in the Stryker Rejuvenate and ABG II Litigation and the DePuy ASR litigation, we have found the reimbursement program with Broadside has been very challenging and frustrating for many people. Although we handle the Broadspire process free of charge for our new and existing clients, we wanted to share the following information that may be helpful to those working with Broadspire based on our experiences.

Broadspire Billing Procedures for Reimbursements Sent Directly to Broadspire by Providers:

No Reimbursements allowed before recall date of August, 2010

Step 1: Have your provider bill your insurance company first.

Step 2: After insurance payments have been processed you will have your provider then send bill to Broadspire along with your Broadspire claim number to this specific address for DePuy ASR claims only:

CLAIMS MUST BE MAILED TO THE ABOVE ADDRESS

Broadspire Billing Procedures for Reimbursements and/or Payments to Providers Sent Directly to Lawyers Office

Step 1:  Will need copy of EOB’s (Explanation of Benefits) from your insurance provider showing any payments by insurance to provider.

Step 2: Need HICF (Health Insurance Claim Form) from providers to send along with EOB’s to Broadspire. This will show the treatment codes to make sure they are related to hip claim.

Step 3: Some medical records may be needed to verify reason for treatment.

Payments will only be made as noted below:

Broadspire will only review and process claims of [claimant’s] under this Agreement to the extent such claims were filed prior to January 1, 2015, or 60 days after a qualifying ASR Revision Surgery under this Agreement, whichever is later regardless of the date of the [claimant’s] enrollment in the U.S. Program under this Agreement and provided they did not participate in the 2013 ASR Master Settlement Agreement.

Thus, if you were revised on or after Dec. 26, 2014 you can still file Broadspire claims as long as the claim is filed within 60 days of the revision date.

Leadership has consistently encouraged everyone to take advantage of this program throughout the litigation and cautioned that its existence is at DePuy’s discretion.   If you have a potential claim, we encourage you to review the criteria immediately and get a claim submitted to Broadspire as soon as possible.

No payments will be made after the date of enrollment of the settlement and payments made between 11/03/14 and date of enrollment are subject to subrogation by Broadspire to be reimbursed back to Broadspire.

Payments will be made if you are not in the settlement as of 11/03/14.
