Justice is Served: CSS Partner Obtains $10 million Dental Malpractice Verdict

Childers, Schlueter & Smith, LLC firm partner, Andy Childers, in tandem with Daniel Moriarty of Moriarty Injury Lawyer, secured a $10 million jury verdict in a dental malpractice trial this month for their client. This could be the largest dental malpractice verdict to ever come out of in the State of Georgia.
Daphne Withrow of Olivetti, McCray and Winthrow, LLC in South Carolina, having worked up the case for over two years after obtaining evidence, attending deposition of the parties, witness, and pretrial hearings, brought in Andy and Daniel for help on the trial. The defendant was found to be negligent when he incompetently performed a root canal on the plaintiff, which caused severe damage to her Inferior Alveolar Nerve. The plaintiff now suffers permanent numbness on the lower left side of her face and Trigeminal Neuralgia a result.
Trigeminal Neuralgia
Trigeminal Neuralgia is an extremely painful condition causes shooting pains in the face that can be triggered by simple and even uncontrollable events such as: wind or air blowing, talking, or even smiling. There was an attempt to repair the plaintiff’s inferior alveolar nerve, however, the attempt failed. The plaintiff will be on pain medications, including opioids, to manage their unbearable pain. The plaintiff will suffer from this condition for the rest of their life.
The $10 Million Result
Plaintiff was 47 years old at the time. Despite her condition, the plaintiff has continued to work. Andy reports that after the verdict, the jury expressed that the $10,000,000 award was the result of the seriousness of the plaintiff’s injuries they will suffer through for the rest of her life.
The defendant maintained that he did not violate the standard of care and continued lie under oath.
Dental malpractice cases have not typically resulted in such a high verdict. We have not yet seen a verdict this large for dental malpractice in Georgia. This is also not the first time Childers, Schlueter & Smith has been involved in such a large verdict.
